The terms governing purchases and use of the ACG Automotive website.

These Terms and Conditions (“Terms”) govern your use of acgautomotive.com and purchases from ACG Automotive (“ACG Automotive,” “we,” “us,” or “our”). By accessing the website, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the website or place an order.
You must be legally able to enter a binding contract to use our purchasing services. You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Information you provide must be current, accurate, and complete.
We try to describe products, pricing, availability, specifications, compatibility, and images accurately. Actual colors, finishes, packaging, specifications, and availability may vary. Vehicle parts can differ by model year, trim, drivetrain, production date, prior modifications, and market. You are responsible for confirming fitment before installation. Contact us before ordering if fitment is uncertain.
Products and services may be modified or discontinued without notice. We may limit quantities, reject or cancel orders, correct errors, or refuse service where reasonably necessary.
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute acceptance. We accept an order when we process it for fulfillment. We may cancel or decline an order because of inventory, pricing or description errors, suspected fraud, payment issues, shipping restrictions, or other operational reasons. If we cancel an order after payment, we will issue an appropriate refund to the original payment method.
Prices are shown in U.S. dollars unless stated otherwise and may change without notice. Applicable taxes, shipping, handling, duties, and other charges will be shown when available during checkout. You authorize us and our payment providers to charge the payment method submitted for your order, including applicable taxes and fees. You represent that you are authorized to use that payment method.
Shipping and delivery estimates are estimates, not guarantees. Delays may occur due to carriers, suppliers, weather, customs, incorrect address information, high order volume, or events beyond our control. Risk of loss and title pass as provided by applicable law and the selected carrier terms. Inspect deliveries promptly and contact us if an item arrives damaged, incomplete, or materially different from what was ordered.
Return eligibility may depend on the product, its condition, manufacturer restrictions, whether it was installed or used, and whether it was custom-made, special-order, electronic, or otherwise non-returnable. Do not ship a return without first contacting us for authorization and instructions. Unauthorized returns may be refused.
Approved refunds are generally issued to the original payment method after the returned item is received and inspected. Original shipping, return shipping, restocking charges, and other non-refundable amounts may apply when disclosed and permitted by law. Nothing in these Terms limits rights that cannot be waived under applicable law.

Automotive performance products can alter power output, emissions, drivability, reliability, fuel requirements, noise, handling, braking, safety systems, and manufacturer warranty coverage. Certain products may be intended only for racing or off-highway use and may not be legal for use on public roads in your jurisdiction. You are responsible for determining legality, compatibility, and appropriate use and for complying with emissions, registration, inspection, and safety laws.
Installation, calibration, and use should be performed by qualified professionals where appropriate. ACG Automotive is not responsible for damage, injury, failed inspections, warranty denial, or legal consequences caused by improper selection, installation, calibration, modification, maintenance, or unlawful use, except to the extent responsibility cannot be excluded by law.
Some products may be covered by a manufacturer’s warranty. Warranty terms, eligibility, exclusions, and remedies are controlled by the applicable manufacturer unless ACG Automotive expressly provides a separate written warranty. Normal wear, misuse, racing, improper installation, unauthorized modification, or failure to follow instructions may affect warranty coverage.
You may not misuse the website, interfere with its operation, attempt unauthorized access, introduce malicious code, scrape or copy content in violation of law, commit fraud, infringe intellectual-property rights, or use the site for unlawful purposes. We may suspend or terminate access for violations.
The website and its text, graphics, logos, photographs, design, software, and other content are owned by or licensed to ACG Automotive and are protected by applicable intellectual-property laws. You may use the site for personal, lawful shopping and informational purposes only. No other license is granted without written permission.
The website may use or link to third-party services, including payment processors, shipping carriers, manufacturers, social platforms, and external websites. Their separate terms and policies apply. We are not responsible for third-party content or services.
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot legally be disclaimed. This section does not alter any express written warranty that applies to a product.
To the fullest extent permitted by law, ACG Automotive and its owners, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, vehicle downtime, or loss of use arising from the website, a product, or these Terms. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid for the product or service giving rise to the claim. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless ACG Automotive and its owners, employees, and agents from claims, losses, liabilities, and expenses arising from your unlawful misuse of the website, violation of these Terms, or improper or unlawful installation or use of products.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to these Terms or a purchase will be brought in a court of competent jurisdiction located in San Diego County, California. Before filing a claim, you agree to contact us and attempt to resolve the dispute informally.
We may update these Terms periodically. Revised Terms will be posted on this page with an updated effective date. The Terms in effect when an order is accepted will govern that order unless a change is required by law.
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, our Privacy Policy, and any product-specific terms presented at checkout constitute the agreement between you and ACG Automotive regarding website use and purchases.
